We have helped an Essex woman win her car park trip claim after she had been told she didn’t have a valid case.
We have again succeeded in an accident compensation claim where other solicitors have failed. In this instance our client was a woman from Grays in Essex who tripped and fell while walking through a car park. Her accident was caused by poorly fitted drainage covers which were running across the centre of the car park. As a result of her fall she suffered injury to her left arm and shoulder.
Before calling our free accident helpline she had appointed another firm of solicitors to bring a car park trip claim on her behalf. However, those lawyers received a flat denial of liability from the the car park owners and she was resigned to not being able to recover compensation for her accident.
However, in one final attempt to achieve justice she called our free helpline. We listened to her story and felt we could use our specialist expertise to win the case. We therefore took over the claim, agreeing to deal with it on a no win, no fee basis.
When we wrote to the car park owners they continued to deny responsibility. However, because we were certain that the claim was a valid one we therefore arranged for court proceedings to be commenced. The confidence we had in the case paid off. Shortly after the issue of court proceedings the Defendants made an offer to settle the claim claim out of court. The offer was acceptable to our client who was delighted to receive compensation, especially after being told that she did not have a valid case.
This case study illustrates how perseverance can pay off. Defendants often deny liability, even when they think their own case is weak, as they know this puts many clients (and their lawyers) off. It also illustrates that our lawyers will not be ‘fobbed off’ by weak denials of liability and will not hesitate to issue court proceedings if that is what it takes to achieve justice.
