Natalie Pratt is often asked, 'do I have to use my own insurance company to bring an injury claim?' The simple answer is, 'no, you don't'. Natalie explains why.

Being in a car accident can be an unsettling time for those involved, especially when you are the innocent victim and there is nothing you could have done to prevent it. Nevertheless the practical consequences need to be sorted out and where you have suffered injury this inevitably raises the issue of who will deal with the legal claim.

Accident victims have a range of options open to them, but in our experience we know people can often feel pressured by their own car insurers to pursue their injury claim through the insurance company and its own nominated solicitors. Indeed it is often presented as though the accident victim has little or no choice in the matter making people feel compelled to bring their claim through their insurers.

However, the actual position is very different.

It is a common misconception that in order to pursue a claim for personal injury you must use the solicitors nominated by your insurance company. While it can seem like that when discussing it with your insurers. the reality is that you can choose whoever you want to represent you.

Although your insurers may have a legitimate interest in dealing with any claim regarding damage to your vehicle, car insurance does not cover you for your injuries. In order to claim injury compensation a legal case has to be brought against the party who caused the accident. And this claim can be pursued on your behalf by any solicitor.
