I’ve been injured in a car accident. Do I have to make my claim through my insurers?

Should road accident victims make a compensation claim through their own insurance company or through an independent solicitor?

If you are in a road traffic accident that wasn’t your fault and you suffered an injury it may be possible for you to make a compensation claim. Motorists have to report any accident they are involved in to their insurers, even if they are not looking to make a claim. It is likely that if you have suffered an injury your insurers will suggest that you make a claim and may encourage you to appoint them to deal with it.

However you don’t have to use the Solicitors provided by your insurance company if you don’t want to.

When deciding whether to use your insurers’ solicitors or whether to appoint independent solicitors it would be wise to consider the following points.

  1. The solicitors recommended by your insurers may work on a bulk basis and have a high case load. If they have an arrangement to deal with all the claims on behalf of your insurers it is likely that they will be a very large organisation dealing with cases on a ‘factory’ scale. You may not therefore receive the one-to-one service you would expect from a smaller, independent firm like ours.
  2. Their recommended firm of solicitors may be so large that they have separate teams of people dealing with each stage of the claim. This means that during the course of a case you may have to deal with a number of different people. By contrast, if you were to instruct a smaller, independent firm of solicitors you are more likely to have the same lawyer through-out the life of your claim.
  3. If you have legal expenses insurance included on your policy it is likely that the terms and conditions state that you will keep 100% of you compensation and not have to pay a success fee. Your insurers may suggest that if you instruct independent solicitors you will have to pay a success fee. However, smaller, independent firms of solicitors are often willing to waive the success fee in such cases.

So, before you decide whether or not to use the solicitors recommended by your insurance company we would suggest that you speak to an independent firm like ourselves to see what we can offer you.
